Ontologies represent the standard way to model the knowledge about specific domains. This holds also for the legal domain where several ontologies have been put forward to model specific kinds of legal knowledge. Both for standard users and for law scholars, it is often difficult to have an overall view on the existing alternatives, their main features and their interlinking with the other ontologies. To answer this need, in this paper, we address an analysis of the state-of-the-art in legal ontologies (...) and we characterise them along with some distinctive features. This paper aims to guide generic users and law experts in selecting the legal ontology that better fits their needs and in understanding its specificity so that proper extensions to the selected model could be investigated. Every organization has to deal with operational risks, arising from the execution of a company’s primary business functions. In this paper, we describe a legal knowledge management system which helps users understand the meaning of legislative text and the relationship between norms. While much of the knowledge requires the input of legal experts, we focus in this article on NLP applications that semi-automate essential time-consuming and lower-skill tasks—classifying legal documents, identifying cross-references and legislative amendments, linking legal terms to the most (...) relevant definitions, and extracting key elements of legal provisions to facilitate clarity and advanced search options. The use of Natural Language Processing tools to semi-automate such tasks makes the proposal a realistic commercial prospect as it helps keep costs down while allowing greater coverage. (shrink)

The automated identification of national implementations of European directives by text similarity techniques has shown promising preliminary results. Previous works have proposed and utilized unsupervised lexical and semantic similarity techniques based on vector space models, latent semantic analysis and topic models. However, these techniques were evaluated on a small multilingual corpus of directives and NIMs. In this paper, we utilize word and paragraph embedding models learned by shallow neural networks from a multilingual legal corpus of European directives and national legislation (...) to develop unsupervised semantic similarity systems to identify transpositions. We evaluate these models and compare their results with the previous unsupervised methods on a multilingual test corpus of 43 Directives and their corresponding NIMs. We also develop supervised machine learning models to identify transpositions and compare their performance with different feature sets. Pleasure is more than a mere sensory event, but rather it can be conceptualized as a complex, multiform experience involving memory, motivation, homeostasis, and, sometimes, negative affects. According to Freud, affect is a perceptual modality that registers the internal drive state of the subject rather than the objective experience of the external world, and the quality of this perceptual modality is calibrated in degrees of pleasure and displeasure. Within this conceptual framework, the aim of drive is always pleasure, and objects (...) become significant in so far as they provide a way of discharging drives pressure. Subsequent conceptual psychoanalytic developments have partially rejected such metapsychological theorizations, postulating that other intrinsic motivations that are independent from libido can be observed in humans. Intrinsic motivation broadly refers to a set of psychological concepts including the inherent propensity to pursue one’s choices, to seek out novelty and challenges, to satisfy curiosity and competence, and to extend one’s capacities and control over events. What these concepts have in common is an inner endorsement of one’s action, which is the sense that action is self-generated and is one’s own. The notions of pleasure, drives, and affects are all of utmost importance for a neuropsychoanalytic understanding of mental functioning, due to their capability to explain desire, thought, and behavior from the perspective of human subjective experience. The purpose of this paper is thus to discuss psychoanalytic conceptual developments that have addressed pleasure, drives, and affects, in the light of recent findings coming from neurosciences. In particular, we will explore for insights from Panksepp’s theory of primary-process emotional feelings, including the notion of “wanting” and “liking” as dissociable components of reward. In the last part of the paper, we will indicate possible theoretical implications for a neuropsychoanalytic understanding of libido-independent intrinsic motivations and their relationship with the self, including neuroscientific observations on self-related processes, agency, body-ownerships, and attachment. This article seeks to address the problem of the ‘resource consumption bottleneck’ of creating legal semantic technologies manually. It describes a semantic role labeling based information extraction system to extract definitions and norms from legislation and represent them as structured norms in legal ontologies. The output is intended to help make laws more accessible, understandable, and searchable in a legal document management system.

This article describes the creation of a lightweight ontology of European Union (EU) criminal procedural rights in judicial cooperation. The ontology is intended to help legal practitioners understand the precise contextual meaning of terms as well as helping to inform the creation of a rule ontology of criminal procedural rights in judicial cooperation. In particular, we started from the problem that directives sometimes do not contain articles dedicated to definitions. This issue provided us with an opportunity to explore a phenomenon (...) typically neglected in the construction of domain-specific legal ontologies. Whether classical definitions are present or absent, laws and legal sources in general are typically peppered with a number of hidden definitions (in the sense that they are not clearly marked out as such) as well as incomplete definitions, which may nevertheless help legal practitioners (and legal reasoning systems) to reason on the basis of analogy or teleology. In this article we describe the theoretical basis for building an analogical lightweight ontology in the framework of an EU project called _CrossJustice_. We present our methodology for collecting the data, extracting the data fields and creating the ontology with WebProtégé, followed by our conclusions and ideas for future work. (shrink)

In December 2017, Law 219/2017, ‘Provisions for informed consent and advance directives’, was approved in Italy. The law is the culmination of a year-long process and the subject of heated debate throughout Italian society. Contentious issues are addressed in the law. What emerges clearly are concepts such as quality of life, autonomy, and the right to accept or refuse any medical treatment – concepts that should be part of an optimal relationship between the patient and healthcare professionals. The law maximizes (...) the value of the patient’s time to decide. Every patient is allowed to make choices for the present as well as for the future, conceived as a continuation of the present, and to decide what comes next, based on what he/she already knows. The law identifies three distinct but converging paths towards the affirmation of a care relationship based on reciprocal trust and respect: the possibility to consent to or refuse treatment, the shared care planning, and advance directives. The fundamental point to emerge from the new Italian law is that consensus is an essential connotation of the treatment relationship. Consensus is not limited to the acceptance/rejection of medical treatment but is ongoing. It is projected into the future through shared care planning and advance directives which act as tools for self-determination and the manifestation of the beliefs and preferences of persons unable to express their will. These principles are in line with the idea of appropriate care as evaluated from two different perspectives, one of scientific adequacy and the other commensurate with the individual’s resources, fragility, values, and beliefs. Surely, however, the new law is not the end of the matter on issues such as conscientious objection, which is deeply rooted within the Italian cultural and political debate. In this regard, healthcare institutions and policymakers will be called upon to develop and implement organizational policies aimed at the management of foreseeable conscientious objection in this field. El trabajo aborda el desarrollo de las clases en Enseñanzas Profesionales de Música durante el confinamiento causado por la pandemia. Se desvelan también las dificultades a las que tuvo que hacer frente el profesorado y las soluciones propuestas. Estamos ante una investigación cualitativa de corte fenomenológico en la que diecinueve docentes de Andalucía fueron entrevistados. Los resultados muestran la complejidad de la virtualización de las asignaturas musicales. Se evidencia también que, a pesar de ser el profesorado firme defensor de la (...) enseñanza presencial, este hecho histórico podría abrir las puertas a nuevos planteamientos educativos antes no explorados en los Conservatorios. This paper describes the Eunomos software, an advanced legal document and knowledge management system, based on legislative XML and ontologies. We describe the challenges of legal research in an increasingly complex, multi-level and multi-lingual world and how the Eunomos software helps users cut through the information overload to get the legal information they need in an organized and structured way and keep track of the state of the relevant law on any given topic. Using NLP tools to semi-automate the lower-skill (...) tasks makes this ambitious project a realistic commercial prospect as it helps keep costs down while at the same time allowing greater coverage. We describe the core system from workflow and technical perspectives, and discuss applications of the system for various user groups. (shrink)

La riflessione del maestro inglese può senz’altro essere considerata per molti versi forte: basti pensare alla piena fiducia riposta nella convergenza di ragione e fede e nella sinergia di metafisica realista e logica della scrittura. Tuttavia, non mancano tracce di debolezza: il discorso teologico del primo Wyclif non solo è più complesso e articolato di quanto non si sia soliti pensare, ma oltretutto sembra condurre a conclusioni ben lontane dall’affermazione estrema e urtante di un unico partito possibile per Dio e (...) per l’uomo. Quanto alle formulazioni più mature, oltre alla possibilità di rintracciare indizi di debolezza nello spirito delle tesi giovanili, sembra anche attestabile la presenza di tracce di indebolimento: questo è il bilancio da trarre circa gli interventi correttivi cui Wyclif sottopose le proprie dottrine teologiche, private con il procedere degli anni del sostegno garantito dai ben congegnati argomenti filosofici.La stessa ricezione del suo pensiero da parte della tradizione può dirsi debole, viziata da fraintendimenti e da letture unilaterali, nonché spesso priva del conforto di riscontri testuali.Il ritratto ben noto del riformatore inglese – alla luce di quanto detto sin qui – reclama forse un ricorso più convinto al chiaro-scuro. Basti pensare al dubbio circa l’efficacia del tentativo proposto proprio nel giovanile De universalibus, così come nel De dominio divino, di una conciliazione tra la necessità degli eventi futuri quoad prescienciam Dei e la libertà umana di determinare le proprie azioni, che pure sembrerebbe suffragata da molte evidenze testuali.Un modo, questo, per dire che la ballata leggendaria di un Wyclif determinista continuerà ancora a essere cantata.
